I. Informacione të përgjithshme
Fondacioni Terre des hommes Lausannë në Kosovë

(në tekstin e mëtejmë TdhK) është një organizatë joqeveritare që punon vazhdimisht në forcimin e sistemit kombëtar dhe lokal të mbrojtjes së fëmijëve, për të siguruar ofrim cilësor të shërbimeve duke përfshirë përfshirjen e grupeve të margjinalizuara shoqërore. Fushat e ekspertizës variojnë nga ndërhyrjet e drejtpërdrejta psiko-sociale me fëmijët e cenueshëm, familjen dhe komunitetet e tyre deri te fuqizimi i politikave dhe institucioneve lokale, rajonale, deri te forcimi i politikave dhe institucioneve në nivel kombëtar, me synimin e ofrimit të shërbimeve të ndjeshme ndaj fëmijëve përmes strukturave, politikave,
standardeve të përshtatshme, buxhetimit dhe procedurave.

TdhK ka tre programe kryesore të ndërhyrjeve: 1) Mbrojtja e Fëmijëve 2) Migrimi dhe Antitrafikimi dhe 3)
Drejtësia për të Mitur.
Në të njëjtën kohë, TdhK përmes programeve të saj mbështet institucionet në forcimin e sistemit të
mbrojtjes së fëmijëve përmes:

a) Angazhimi në ndërhyrjet politike dhe/ose dialogu me Ministritë, Komisionet Parlamentare,
Institucionet Akademike dhe aktorë të tjerë të rëndësishëm;
b) Mbështetja e përpjekjeve për zbatimin e Ligjit për Mbrojtjen e Fëmijëve dhe Kodit të Drejtësisë
për të Miturit, nëpërmjet hartimit të të gjitha akteve nënligjore dhe dokumenteve përkatëse që
rrjedhin prej tyre;
c) Mbështetja e kapaciteteve të strukturave brenda sistemit kombëtar të mbrojtjes së fëmijëve dhe
d) Pilotimi i politikave të reja të shërbimit social me qëllim të nxjerrjes së mësimeve dhe/ose
replikimit.

II. Informacione rreth projektit
Fondacioni Terre des hommes Lausannë në Kosovë
është duke zbatuar projektin "Drejtësia sociale për Romët, Ashkalitë dhe Egjiptianët në Kosovë", në partneritet me organizatën Zëri i Romëve, Ashkalinjve dhe Egjiptasve (VoRAE) dhe Swiss Church Aid
(HEKS/EPER).
Qëllimi i përgjithshëm i konsorciumit dhe vizioni është një shoqëri multi etnike dhe multi kulturore në Kosovë, ku pjesëtarët e komuniteteve Rom, Ashkali dhe Egjiptian trajtohen si të barabartë nga shteti dhe nga shoqëria, ku kanë qasje dhe mundësi të barabarta sikur të gjithë qytetarët e tjerë dhe ku Romët,

Ashkalit dhe Egjiptianët njohin të drejtat dhe detyrat e tyre.
Përmes një sërë veprimesh avokuese, konsorciumi ka ndikuar në ndërtimin e kornizës ligjore dhe politikat e Qeverisë dhe ka ndikuar në marrjen e vendimeve që kanë avancuar përfshirjen sociale të komuniteteve Rom, Ashkali dhe Egjiptian. Duke mobilizuar bashkëpunëtorët në nivel lokal dhe nacional, konsorciumi
krijoi me sukses sinergjinë e nevojshme për të rritur dhe avancuar politikat dhe integrimin institucional të
intervenimeve që tashmë ishin testuar dhe zbatuar me sukses.
Në dhjetor të vitit 2023, është aprovuar Ligji për shërbime sociale dhe familjare. Ky ligj rregullon shërbimet sociale dhe familjare për personat në nevojë dhe familjet që janë në nevojë, detyrat dhe përgjegjësitë e institucioneve publike që hartojnë politika dhe ofrojnë shërbime sociale dhe familjare si dhe detyrat dhe përgjegjësitë e institucioneve private që ofrojnë shërbime sociale dhe familjare.

Objektivi i shërbimit:
Fondacioni Terre des hommes Lausannë në Kosovë (TdhK) do të kontraktojë një ekspert lokal i/e cila ka
kapacitete njerëzore, etike, profesionale dhe teknike për hartimin e aktit nënligjor – “Rregullores për organizimin dhe fushëveprimin e qendrave për kujdes ditor” në përputhje me Ligjin për Shërbime Sociale dhe Familjare dhe standardet ndërkombëtare. Akti nënligjor rrjedh nga neni 61 (Qendrat e Kujdesit Ditor) i Ligjit për Shërbime Sociale dhe Familjare, i cili përcakton se për përkujdesin ditor dhe shërbime ditore në
komunitet themelohen Qendrat e Kujdesit Ditor. Qendrën e Kujdesit Ditor, mund ta themelojë Ministria, komuna, organizatat joqeveritare, personi fizik apo juridik në pajtim me ligjin. Qendrat e Kujdesit Ditor për përkujdesjen ditore dhe shërbime sociale, janë: Qendra e Kujdesit Ditor për fëmijë; Qendra e Kujdesit
Ditor për të rritur dhe të moshuar; Qendra për shërbime sociale të specializuara. Organizimi dhe fushëveprimi i Qendrave për Kujdes ditor rregullohet me akt nënligjor të propozuar nga Ministria dhe të
miratuar nga Qeveria.
Grupi punues është themeluar me vendim nga Ministria e Drejtësisë ndërsa eksperti/ja i/e angazhuar do të jetë përgjegjës që në koordinim me kryesuesin dhe anëtarët e grupit punues të hartojë dhe finalizoj draftin e rregullores derisa të jetë i gatshëm për aprovim nga Qeveria.

PËRSHKRIMI I PUNËS:
I. Funksione thelbësore të konsulencës:

• Eksperti do të kryejë detyrat e tyre në lidhje me statutin e TdhK dhe Politikën e Mbrojtjes së
  Fëmijëve të TdhK.
• Eksperti do të marrë përsipër dhe do të kryejë detyrime në interes të TdhK në të gjitha rrethanat.
• Eksperti do të drejtojë aktivitetet dhe angazhimet e tyre pavarësisht nga bindjet politike, racore
  apo fetare.

II. Përgjegjësitë:
Në bashkëpunim të ngushtë me grupin punues, eksperti/ja do të kenë përgjegjësitë në vijim:

• Hartimi i draftit të parë të aktit nënligjor - Rregullores për organizimin dhe fushëveprimin e
  qendrave për kujdes ditor.
• Dorëzimin e draftit tek grupi punues i themeluar zyrtarisht për t'u përdorur si bazë për diskutim
  gjatë procesit të zhvillimit të rregullores;
• Angazhimin e plotë dhe proaktiv në bashkëpunim me grupin punues të themeluar sipas vendimit
  të lëshuar nga Ministria e Drejtësisë;
• Mbështetjen e kryesuesit të Grupit Punues në lehtësimin e punëtorive;
• Pasqyrimin e komenteve të konsultimeve në përmbajtjen e rregullores.
• Njoftojnë dhe raportojnë lidhur me punën e realizuar tek Tdh dhe zyrtarët përgjegjës nga Ministria e Drejtësisë;
• Mbajtjen e qasjes neutrale dhe profesionale gjatë gjithë procesit;
• Kryerjen e detyrave duke respektuar statutin e Tdh-së dhe Politikën e Tdh-së për mbrojtjen e
  fëmijëve.

III. Koha
Detyra është paraparë të kryhet brenda 10 ditëve të punës brenda periudhës nga muaji korrik 2024 deri
në dhjetor 2024.

Datat vendosen pas një marrëveshjeje të ndërsjellë midis Ekspertit/Ekspertes, Ministrisë së Drejtësisë
dhe Terre de hommes.

IV. Kriteret e Përzgjedhjes

• Diplomë universitare në drejtësi, shkenca sociale ose fusha të tjera të ngjajshme.
• Së paku 5 vite përvojë pune në draftimin e akteve nënligjore, udhëzimeve administrative, rregulloreve dhe protokolleve të punës në fushën e shërbimeve sociale dhe familjare.
• Të ketë shkathtësi të shkëlqyeshme analitike dhe konceptuale;
• Të ketë shkathtësi të shkëlqyeshme në shkrim dhe komunikim;
• Duhet të ketë njohuri të mira për sistemin e të drejtave të fëmijëve dhe mbrojtjes së fëmijëve;
• Të ketë njohuri të mira për sistemin e shërbimeve sociale dhe familjare;
• Të ketë përvojë dhe punë të dëshmuar me institucione nga sektori shoqëror dhe organizata që
  ofrojnë shërbime sociale;
• Duhet te ketë përvojë të dëshmuar të bashkëpunimit efektiv me institucionet publike në nivelin qendror dhe lokal, ofruesit e shërbimeve publike dhe OJQ-të;
• Njohuri të thella të legjislacionit të mbrojtjes së fëmijëve dhe shërbimeve sociale e familjare.
• Përvojë në udhëheqjen e grupeve punuese dhe konsultimeve me përfaqësues të institucioneve, OJQ-ve dhe bashkëpuntorëve të tjerë.
• Aftësi të shkëlqyra të të shkruarit dhe materiale të publikuara.
• Aftësi të shkëlqyeshme në koordinim, komunikim dhe organizim;
• Njohja e kontekstit në Kosovë dhe Rajon dhe përvoja praktike e punës në vend është një avantazh i fuqishëm.

I. Background Information
Terre des hommes Lausanne Foundation in Kosova (hereafter TdhK) is a Non-Governmental Organisation
working consistently on strengthening the national and local child protection system, to ensure qualitative delivery of services including inclusion of socially marginalized groups. Areas of expertise range from direct psycho-social interventions with vulnerable children, their family, and communities to empowerment of local, regional, to strengthening national level policies and institutions, with a view of delivering child-sensitive services through adequate structures, policies, standards, budgeting and procedures.

TdhK has three main programs of interventions: 1) Child Protection 2) Migration and Anti-Trafficking and
3) Juvenile Justice.

At the same time, TdhK through its programs supports institutions in strengthening the child protection
system through:

a) Engagement in policy interventions and/or dialogue with Ministries, Parliament Committees,
Academic Institutions and other important actors;
b) Supporting the efforts to implement the Child Protection Law and the Juvenile Justice Code,
through the drafting of all by-laws and relevant documents derived from them;
c) Supporting the capacities of the structures within the national child protection system and
d) Piloting new social service policies with a view of lesson learning and/or replication.

II. General information about the project
Terre des hommes Lausanne Foundation in Kosova is implementing the project "Social Justice for Roma, Ashkali and Egyptians in Kosovo" in partnership with the organization Voice of Roma, Ashkali and Egyptian communities (VoRAE) and Swiss Church Aid (HEKS/EPER).
The Consortium's overall goal and vision is for - a truly multi-ethnic and multi-cultural society in Kosovo, where Roma, Ashkali and Egyptian people are treated as equals by the state and society, with access to the same opportunities as everyone else, and where Roma, Ashkali and Egyptian people know their rights and their societal responsibilities.
Through a range of advocacy actions, the Consortium has influenced important Government policy frameworks and generated decisions that advanced the social inclusion of Roma, Ashkali and Egyptian
communities. By mobilising stakeholders at local and national level, the Consortium successfully created the necessary synergy to scale-up and advance the policy and institutional mainstreaming of interventions
that were already tested and successfully implemented.

On December 2023, the Law on Social and Family Services has been approved. This Law shall regulate social and family services for persons in need and families in need, duties and responsibilities of public
institutions that draft policies and provide social and family services as well as duties and responsibilities
of private institutions that provide social and family services.

Objective of the service:
Terre des hommes Lausanne Foundation in Kosova (TdhK) will contract a local expert who has the human, ethical, professional and technical capacity to draft a sublegal act on the “Integrated Services” in compliance with the Law on Social and Family Services and international standards. The sub-legal act
derives from Article 14 (The right to social and family services) of the Law on Social and Family Services,
which stipulates that social and family services include activities, measures and programs intended for the
prevention, identification, protection, rehabilitation, reintegration and resolution of problems and
difficulties of the individual and the family, as well as for improving the quality of their life in the community. Social and family services can be provided temporarily or for a long period, depending on the needs of the beneficiary and are organized as services for children, young people, families and adults and elderly people, respecting the social ties of the circle of beneficiaries and family. Depending on the needs of the beneficiary, social services can be offered simultaneously and in combination with the services offered by educational institutions, health and other service providers (hereinafter: integrated services).
Integrated services are regulated by a sub-legal act proposed by the Ministry and approved by the
Government.
The working group has been established by decision of the Ministry of Justice, while the engaged expert
will be responsible in coordination with the chairperson and group members to draft and finalize the draft
administrative instruction until it is ready for approval by the Government.

JOB DESCRIPTION:
I. Essential Functions of the Consultancy

• The expert will conduct their duties in respect to the TdhK charter and the TdhK Child Protection Policy.
• The expert will undertake and perform obligations in the interest of TdhK in all circumstances.
• The expert will direct their activities and engagements regardless of political, racial or religious convictions.

II. Responsibilities
In close cooperation with the working group, the expert will have the following responsibilities:

• Drafting of the first draft of the by-law - Regulation on the organization and scope of day care centers.
• Submitting the draft to the officially established working group to be used as a basis for discussion
  during the regulation development process.
• Full and proactive engagement in cooperation with the working group established according to the decision issued by the Ministry of Justice.
• Supporting the Working Group chairperson in facilitating the workshops.
• Reflecting the comments of the consultations in the content of the regulation.
• Notify and report on the work carried out at the Ministry of Justice and responsible officials.
• Maintaining a neutral and professional approach throughout the process.
• Carrying out duties respecting the statute of Tdh and the Policy of Tdh for the protection of children.

III. Timeline
The task is foreseen to be completed in up to 10 working days within the period between July 2024 –
December 2024.

The dates will be decided with a mutual agreement between the Expert, the Ministry of Justice and
Terre de hommes.

IV. Selection Criteria

• University degree in law, social sciences or other similar fields.
• At least 5 years of work experience on drafting bylaws, administrative instructions, regulations and working protocols in the field of social and family services.
• To have excellent analytical and conceptual skills;
• To have excellent skills in writing and communication;
• Should have good knowledge of the children's rights system and child protection;
• To have good knowledge of the social and family services system;
• To have experience and proven work with institutions from the social sector and organizations that offer social services;
• Should have proven experience of effective cooperation with public institutions at the central and local levels, public service providers, and NGOs.
• In-depth knowledge of child protection and social and family services legislation.
• Experience in leading working groups and organizing consultations meetings with institutional, representatives, NGS, and other relevant stakeholders.
• Excellent writing skills and published materials.
• Excellent coordination, communication and organizational skills;
• Knowledge of the Kosovo and regional context and the practical experience of working in the country is a strong advantage.
